Title I. Appointment and Term
APPOINTMENT
• Unless these By-Laws specify otherwise, the Committee on Committees
appoints all committees of the Division and designates their chairs.
•
It may also appoint a panel of alternates (prescribing their order of priority)
to serve whenever a regular member is temporarily unable to serve.
•
All appointments by the Committee on Committees are subject to confirmation
by the Divisional Council. (CC. 10.89)
- TERM
Committees are appointed each year to serve for a term of one year, beginning with the first day of instruction of the Fall term, unless otherwise specified.
Title II. General Functions and Responsibilities; Composition
- GENERAL FUNCTIONS AND RESPONSIBILITIES
- Committees may make such studies and recommendations as they deem appropriate, consistent with their original charge.
- Members of the Division have the right to be heard by appropriate Divisional Committees.
- Each Committee is responsible to the Division and has the obligation to report its actions to the Division, but has the right to report concurrently to the Assembly of the Academic Senate.
- When committees make recommendations and render advice to the President, Chancellor, other administrative officers, departments, or individual members of the Division, they are to report their recommendations to the Division when such report is in the best interest of the University.
- Committees may adopt rules for the conduct of their business consistent with the By-Laws and Regulations of the Division.

Standing Committees of the Berkeley Division of the Academic Senate are divided into two categories:

- Student Participation
Student members shall be eligible to serve on all standing sub-committees of those Committees listed in By-Law 13.C.1. - Student Selection and Appointment (Am. 4.90, 10.90)
- Selection
During the Spring term, student members for each of the Committees on Educational Affairs will be selected by a Search and Selection Committee (not itself a Senate Committee), and appointed by the Divisional Committee on Committees. Names of student members shall be sent to the Committee on Committees by June 1 of the term before the academic year in which they are to serve.
Ex Officio Members:-
The Search and Selection Committee shall have as an ex officio, non-voting member the Faculty Representative to the ASUC. The remainder of the Committee is to consist of students as prescribed by ASUC By-Laws.
- The ex officio titles of student members of the Search and Selection Committee and the procedures by which the Committee will select student members for the Berkeley Division Committees shall be communicated in writing to the Secretary of the Division by the first week of the Spring semester.
- Nonfulfillment
Failure of the ASUC to provide student nominees for Divisional Senate Committees, as specified above, shall not interfere with the ongoing functioning of Berkeley Divisional Committees.
Grievance Board
Complaints by a Divisional Committee against a student member or by a student member against the Committee to which the student has been appointed shall be referred on the initiative either of the student or of the Committee Chair for resolution to a Grievance Board composed of the Chair of the Committee on Committees, the Faculty Representative to the ASUC, and the Chair of the Graduate Assembly. - Voting Procedure

On all formal votes in committees attended by student members, the student opinions will be recorded separately and so reported whenever the recommendation of the committee is presented to the Division, to other Academic Senate bodies and to administrative officers advised by such committee. ASSEMBLY REPRESENTATION
Membership
This Committee consists of: • Chair of the Division, who is its
Chair;

Those other members of the Division who are ex officio members of the Assembly
of the Academic Senate;

Appointed Divisional representatives to the Assembly (as prescribed in Senate
By-Law 105.A.4) appointed for two-year staggered terms; at least half of whom

At least six alternate Divisional Representatives, designated by the Division Chair
to serve in the absence of a regular Representative (Legislative Ruling 4.71; Am. 4.24.08).
- BUDGET AND INTERDEPARTMENTAL RELATIONS
- Membership
This Committee has at least seven members.
- Duties
It represents the Division in all matters relating to appointments and promotions and makes recommendations to the Chancellor on appointments, promotions, salaries, and other matters related to the quality of the faculty.
- Term
Its term of office begins on July 1.

- Membership
- This Committee has eight elected members, who are elected in acccordance with Senate and Division By-Laws.
- It chooses its own Chair, who is also a member of the Grievance Board as provided
in By-Law 13.
- Terms and Vacancies
- Four members are elected each year to serve for two years beginning the first day of instruction in the Fall.
- When a vacancy in its own membership occurs, the Committee, subject to confirmation by the Divisional Council, may appoint a member of the Division to serve the unexpired part of the term. (CC.10.89)
- The committee is instructed to give consideration to nominees not elected but receiving highest vote in the immediately preceding election.
- Duties
This Committee appoints:
- The Chair, Vice Chair, Secretary and Parliamentarian of the Division;
- All other Standing Committees;
- Special Committees as the Division may direct;
- Faculty Representative to the Senate of the Associated Students of the University
of California, who also serves as a member of the student Search and Selection
Committee and the Grievance Board, as provided in By-Law 13.C;
- Nominees for appointment to administrative committees when called upon by the
Chancellor; in particular, nominees to all positions on the Chancellor's Committee
for Animal Care and Use, except for non-Senate and outside University members;
- All Senate members of the Graduate Council's Standing Committee for Protection of Human Subjects; appoints a Senate member for its Chair in consultation with the Chair of the Graduate Council and the Vice Chancellor for Research; appoints its student members in accordance with By-Law 13.C (En. 4.88; Am. 11.13.03);

- ELECTIONS[3]
- FACULTY AWARDS
- Membership
This Committee has at least seven Senate members from various disciplines.
- Duties (Am. 4.25.05)
This committee nominates candidates for the Clark Kerr Award, the Berkeley
Faculty Service Award, and other awards, honors, and prizes.
1. Clark Kerr Award
•
From time to time it nominates to the Divisional Council, for presentation
of the Clark Kerr Award, an individual considered to have made an extraordinary
and distinguished contribution to the advancement of higher education.
•
The Award consists of a medal bearing the profile of Clark Kerr and a suitable
inscription.
•
Cost of the Award is borne by voluntary contributions from the Faculty or other
funds available to the Division, but not by State moneys.
2. Berkeley Faculty Service Award
•
Annually the committee solicits nominations and recommends to the Divisional
Council, a member of the Berkeley Division who has given outstanding and dedicated
service to the Berkeley campus.
•
This Award consists of a monetary award equivalent to that of the Distinguished
Teaching Award, and a commendation modeled on the Berkeley Citation.
3. Other awards, honors, and prizes
•
For some external awards, the committee supplies nominees to the Office of
the Chancellor upon request.
•
In other cases, the committee interacts directly with schools, colleges, and
departments through their designated award committees or individuals to identify
nominees.
•
The committee encourages schools, colleges, and departments to nominate their
faculty for appropriate external awards and, if desired, to establish a mechanism
for nominations.
- FACULTY RESEARCH LECTURE
- Membership
• This Committee consists of the most recent Faculty Research Lecturers,
to a maximum number of ten.
•
In each academic year, it elects its chair for the following year.
- Duties
This Committee is to nominate for approval by the Divisional Council two members of the Division who have made distinguished records in research, each to deliver a lecture upon a topic of his or her choice. (CC. 10.89)
- FACULTY WELFARE[4] (Am. 4.25.05)
Duties
This Committee works with campus administrators on matters concerning the general
welfare of the faculty, such as conditions of employment, salary policy, benefits,
dependent care, housing, and retirement; it reports and recommends to the Division
on these issues. (Am. 4.25.05)
- MEMORIAL RESOLUTIONS
- Membership (Am. 12.87)
This Committee has at least three members.
- Duties
- This Committee is responsible, on behalf of the Division, for preparation and publication of commemorative statements concerning the lives and services to the University of deceased members of the Division, and other members of the University community whom the Committee, at its discretion, may chose to memorialize. - It may appoint such subcommittees as may in each case be appropriate.
- OMBUDSPERSONS (Am. 3.92)
- Membership
This is a committee of at least three. (Am. 10.19.00)
- Duties
Members of the committee hear complaints, except as noted below, from academic
personnel regarding actions by members of the Division and other officers of
the University, by students, or by staff.
- Procedures
- They are not required to hear, to investigate, or to act on complaints, but may do so if they choose; they may refer complaints to other agencies of the University.
- When investigating a complaint, they may question members of the Division and may have access to relevant documents of the Division or its agencies, except for the confidential files of the Committee on Budget and Interdepartmental Relations.
- After completing their investigation, they may make recommendations to appropriate agencies of the University.
- Files of the Committee shall be confidential. Reports or public statements of the Ombudspersons Committee will, under no circumstances, make reference to specific information in confidential personnel files.
- The Ombudspersons will not hear complaints that fall within the jurisdiction of the Committee on Privilege and Tenure unless referred to them by that Committee but they may take cognizance of complaints alleging improper procedures by the Committee on Privilege and Tenure.
- PRIVILEGE AND TENURE

- Duties
- This Committee takes cognizance of matters in accordance with Academic Senate Bylaws 334, 335, 336, and 337. (Am. 4.29.07)
- The principles and procedures governing its conduct are set forth in Senate By-Laws 334, 335, 336, and 337. (AM 10.24.02)
- RESEARCH
- Membership
This Committee has a Chair, a Vice Chair, and at least fifteen members.

- Duties (Am. 11.14.06)
- This Committeee advises the Division in all matters pertaining to the research mission of the Division and the University;
- Confers with and advises the Chancellor and the Vice Chancellor-Research on faculty perspectives regarding resesarch policy matters;
- Maintains regular contact with other Committees of the Division on matters relating to research policy and allocations, such as the Committees on the Library, Computing and Communications, and Academic Planning and Resource Allocation;
- Establishes policies and procedures governing allocations to the Committee, administers and allocates funds designated for research and travel grants, and;
- Makes recommendations to the VC-Research based on review reports of Organized Research Units.
- RULES AND ELECTIONS (Am. 10.25.94, 11.8.07)
Membership
This Committee consists of at least three Senate members. The Secretary of the Division shall serve as chair of this committee. (Am. 10.25.94)
Duties- This Committee prepares and reports to the Division, or to any of its Faculties, such changes and additions to their By-Laws and Regulations as it deems advisable;
- Formally supervises all changes and additions to the By-Laws and Regulations proposed by other committees or by individuals;
- Edits and publishes the Manual of the Berkeley Division at such intervals as it deems expedient; and
- Determines whether a person meets the conditions for membership in the Division.
- By vote of the Division, issues of interpretation of Divisional legislation may be referred to this Committee for decision and report.
- Such decisions are subject to review by the Division, either when the report is made or on petition signed by twenty-five voting members of the Division. The final date for filing such petition is ten days after the minutes of the Division reporting the decision are placed in the mail.
- If the Division disapproves the report of the Committee, the Committee must at once draft legislation which expresses the intent of the Division.
- This Committee supervises all elections of the Division and voting on propositions submitted to the Division by mail or electronic ballot. (Senate By-Law 340 and Berkeley Division By-Law 9)

- SENATE POLICY [5]
- UNIVERSITY-EMERITI RELATIONS
- Membership
This Committee has at least five members, of whom at least three are emeriti and one of whom will be a member of the Committee on Faculty Welfare. (Am. 10.19.00; CC. 4.25.05)
- Duties
The Committee:
1. Represents the interests of emeriti and communicates their needs to the
appropriate bodies of the Division;
2. Works closely with the Retirement Center and the Berkeley Emeriti Association
to maintain communication with the emeriti and assess their interests and needs;
3. Maintains liaison with Committee on Faculty Welfare and appoints subcommittees
to maintain liaison with other academic bodies as deemed appropriate; and (CC. 4.25.05)
4. Serves as a resource for the Retirement Center and assists the Center in
identifying and responding to the needs of emeriti as appropriate. (Am. 11.13.03)
Title IV. List of Standing Committees on Educational Affairs:

These committees include Senate and student members.
Student members are appointed, and shall serve,
in accordance with provisions of By-Law 13.C.
- ACADEMIC FREEDOM
- Membership
This Committee has five Senate members and two student members.[6]
- Duties
The duty of this Committee is to study and report upon any conditions within or without the University which, in its judgement, may affect the academic freedom of the University, with particular reference to the acceptance of positions and resignations from positions in the University, and to the reputation of the University and of individual members of its faculty.
- ACADEMIC PLANNING AND RESOURCE ALLOCATION (Am. 9.91, 3.92)
- Membership
This Committee has at least twelve members: a Chair, a Vice Chair, and at least four Senate members at large, appointed by the Committee on Committees; four
ex officio members: Vice Chair of the Divisional Council, Chair of the Committee on Budget and Interdepartmental Relations, Chair of the Library Committee, the ASUC Vice President for Academic Affairs; and one additional student member.[7] (Am. 4.24.08)
- Duties
- Confer with and advise the Chancellor on policy regarding academic and physical planning, budget, and resource allocation, both annual and long range.
- Initiate studies in planning and budget matters, and if necessary to accomplish the study, authorize establishment of ad hoc committees.
- Maintain liaison with other Committees of the Division on matters relating to budget and planning.
- Report regularly to the Divisional Council and to the Division.
- ADMISSIONS, ENROLLMENT, AND PREPARATORY EDUCATION (Am.10.25.94)
- Membership
This Committee consists of at least six Senate members, normally serving three
year staggered terms, the Assistant or Associate Vice Chancellor-Admissions
and Enrollment, as a voting member, two student members, the Director of
Undergraduate Admissions, as a non-voting member. The student members are
appointed, and shall serve, in accordance with the provisions of Bylaw 13C.

- Duties
- This Committee considers and reports on matters involving admissions and enrollment at Berkeley.
- This Committee exercises in the Division responsibilities regarding preparatory education that are assigned by the systemwide Senate Committee on Preparatory Education and by the Division. (Am. 10.25.94; EC 6.00)
- COMPUTING AND COMMUNICATIONS
- Membership
This Committee consists of at least nine Senate members and two student members.[8] (Am. 4.22.03)
- Duties
- Advises the Chancellor and the Division on all matters relating to utilization and integration of computers, information systems, and electronic communications facilities into academic programs, including policy matters pertaining to computer and communications facilities;
- Represents the Division and its Faculties in all matters of policy concerning computers, computing, data, and telecommunications facilities;
- Submits recommendations for the improvement of facilities in all three areas.
- It is specifically charged to:
- Review faculty and student use of computing and communications facilities for instruction and research;
- Recommend ways to improve the functioning of computing and communications facilities to meet faculty and student needs; and
- Participate in long-range planning for communications computer use and development.
- COURSES OF INSTRUCTION
- Membership
This Committee consists of at least twelve Senate members, one of whom should normally be a member
of the Committee on Courses of Instruction and Academic Programs of the College of Letters and Science,
the Secretary of the Division as an ex-officio member, three student members, and the Registrar,
ex officio, as a non-voting member.[9] (Am. 10.25.94; 4.29.97; 11.13.03)
- Term of Office
The term of office of the Committee begins on Monday of the third week of instruction in the
Fall term.
- Duties
- Reviews, coordinates, and takes final action on all matters relating to courses of instruction, including approval of new courses; modification, withdrawal, conduct, credit valuation, and classification of existing courses; and consults with and advises departments and individual members of the Division on courses of instruction.
- Gives full consideration to the views and conclusions of appropriate departments, departmental committees and representatives, and faculty members when matters related to their courses of instruction come before the Committee.
- Neither advises on, nor has any jurisdiction over, courses in the School of Law. [SOR 105.2(b)]
- Acts on behalf of the Division in reviewing recommendations from the colleges, schools, and Graduate Council concerning the award of degrees, certificates, and honors (See By-Law 100).
- Reviews and takes final action on requests for exceptions to Division Regulations governing courses of instruction and the awarding of degrees, certificates, and honors. (Am. 4.27.06)
- EDUCATIONAL DEVELOPMENT, COUNCIL ON [10]

- Considers and reports upon matters involving questions of educational policy;
- Initiates proposals involving questions of educational policy;
- Advises the Division in all matters relating to educational policy,
including significant changes in the allocation of campus resources;
- Makes recommendations to the Divisional Council on the establishment and disestablishment
of curricula, colleges, schools, departments, institutes, bureaus and the
like (See Regulation 300. American Cultures Breadth Requirement) (CC. 4.89);
and
- Participates in campus program review of academic departments and units,
paying special attention to matters involving undergraduate education.
- ETHNIC STUDIES CURRICULA, Council for[12]
- GRADUATE COUNCIL
- Membership
- The Graduate Council shall comprise the Dean of the Graduate Division, ex officio, at least twelve other Senate members, and three graduate students.[13]
- The Chair and Vice Chair are designated by the Committee on Committees from among the appointed members.
- Duties
- The Council exercises administrative and coordinating functions in the Graduate Division at Berkeley in accordance with Senate By-Law 330.
- The Council may delegate its authority for the approval of graduate courses, numbered 200-299, to the Divisional Committee on Courses of Instruction. (EN 4.22.03)
- The Graduate Council may adopt bylaws setting out the membership and procedures for appointment of its standing committees. (En. 11.8.05)
- INTERNATIONAL EDUCATION (Am.11.88; Am. 10.19.00, Am. 4.29.04)
- Membership
This Committee has at least seven Senate members, one of whom shall also be a
member of the Committee on Educational Policy; as ex-officio members, the Dean
of International and Area Studies, the Director of the Berkeley Programs for
Study Abroad, and two student members (one undergraduate and one graduate) appointed
in accordance with By-Law 13.C. The Committee has a Chair and a Vice Chair.
- Definition
For the purpose of this bylaw, “international education” shall
be defined as university programs outside the United States in which Berkeley
students are enrolled.
- Duties
This Committee:
- Advises the Senate and the Chancellor on matters related to international
education and the status and welfare of international students and
scholars on the Berkeley campus;
- Advises and consults with
the Dean of International and Area Studies, the Director of Berkeley
Programs for Study Abroad, and the Director of Berkeley International
Office (CC. 10.1.07);
- Initiates policy recommendations regarding
international education, including the Education Abroad Program
and the status and welfare of international students and scholars
on the Berkeley campus; and
- Provides guidance, advice,
and oversight regarding all academic matters related to international
education. These matters include issues related to the Education
Abroad Program, such as student selection, selection of Study
Center Directors, and reviews of Study Centers.
- LIBRARY
- Membership

- Duties
- Advises the Chancellor regarding administration of the Library; and
- Performs such other duties relative to the Library as may be committed to the Division.
- PRIZES

- Duties
This Committee supervises the award of such prizes, not otherwise provided for, as are restricted to students on the Berkeley Campus.
- SPECIAL CURRICULA, Council for (CC. 3.92)[16]
- STUDENT DIVERSITY AND ACADEMIC DEVELOPMENT (Am. 4.25.05)
- Membership
- This Committee consists of at least ten Senate members
and of two student members. [17]
- The Committee may nominate as non-voting members, for approval by the
Committee on Committees, such non-members of the Academic Senate, to a maximum
of five,
as it deems advisable.
- Duties (Am. 4.25.05)
This committee advises, aids, and reviews academic
preparation and development programs (from pre-college to graduate level)
in order to help such programs
encourage and aid students of the highest academic promise who have encountered
restricted educational opportunities due to racial, ethnic, and/or gender
preferences or other social or economic conditions.
This committee seeks to aid the development of the full potential of such
students, particularly in those areas of study and work in which students
who have encountered restricted educational opportunities are poorly represented,
and thereby to promote student diversity on campus and in the professions.
This committee encourages and aids members of the Berkeley faculty to
participate in achieving the goals outlined above.
- STATUS OF WOMEN AND ETHNIC MINORITIES
- Membership
This Committee consists of at least five Senate members and of two student members, and the Associate Vice Provost for Faculty Equity, ex officio as a voting member.[18] (Am. 4.25.02; Am. 4.25.05)
- Duties
- To stimulate and aid all departments in strengthening their efforts to foster and achieve equality of opportunity for women and minorities;
- To conduct continuous review of all problems concerning the status of women and ethnic minorities on the Berkeley Campus; and
- To report to the Division annually on the progress of the Campus in achieving equality of opportunity for women and minorities.
- STUDENT AFFAIRS
- Membership
This Committee has at least four Senate members, the President of the Associated Students of the University of California (Berkeley), ex officio, one graduate student, and one undergraduate student.[19] (Am. 10.19.00)
- Duties
This Committee shall act as a forum for the exchange of views among faculty, students and administrators in order to enhance the quality of student life, thereby strengthening the campus community. Accordingly, this Committee shall address issues pertaining to social welfare (e.g., health, safety), intellectual growth (e.g. academic support), and ethical development (e.g., community service, student and faculty conduct." - Membership
This Committee has at least five Senate members, of which a minimum of two should
be past recipients of the Distinguished Teaching Award, and two student members,
one undergraduate and one graduate student. [20]
- Duties
- Stimulate and aid all departments to strengthen their efforts to foster, recognize, and reward good teaching;
- Nominate members of the Faculty for approval by the Divisional Council
to receive Distinguished Teaching Awards and other awards as appropriate. Upon
request from the Chancellor or members of the Chancellor’s cabinet, solicit
and submit nominations of faculty members as potential recipients of external
awards for teaching.
- Initiate, receive, and fund proposals for instructional
improvement and development.
- Undertake special activities to improve teaching and learning on campus.
- Study all problems concerning improvement of teaching on the campus and
its recognition through promotion and tenure and, from time to time, make
pertinent recommendations to the Berkeley Division.
- PREPARATORY EDUCATION[21]
- UNDERGRADUATE SCHOLARSHIPS AND HONORS

This Committee has at least 15 Senate members and two student members.[22] (Am. 4.88)
- Duties
- Recommends to the President, through the Chancellor, award of such undergraduate scholarships as are restricted to students on the Berkeley Campus.
- Determines criteria for award of undergraduate honors and Honors with the Bachelor's Degree.
- Recommends to the Chancellor policies related to the awarding of all undergraduate financial aid on the Berkeley campus. (Am. 11.13.03)
- UNIVERSITY EXTENSION
- Membership
This Committee has seven Senate members, three student members (preferably one undergraduate, one graduate, and one with direct experience of Extension), and Chair, ex officio, of the Committee on Courses of Instruction, or an alternate Senate member, ex officio, from the Courses Committee designated by its Chair. The Dean of the University Extension serves, ex officio, as a non-voting member of the Committee. - Advise the Chancellor and the Dean of University Extension on any matters referred to the Committee or initiated by it, concerning the functions and the educational and related budgetary and personnel policies of University Extension.
- Advise the Dean of University Extension and the departments, schools, Colleges, and the Graduate Division with respect to:
- Establishment and discontinuance of Extension programs;
- Criteria for appointment and retention of Extension teaching staff;
- Policy on acceptance of extramural support for Extension programs.
- Advise the administration on personnel matters, providing performance reviews and appraisals when appropriate.
- Coordinate, in such respects as it deems advisable, the relations of University Extension with the Division.
